Update:IV CPC Rank Pay Case as on 17 Feb 14

The Contempt Petition in the IV CPC rank pay filed by RDOA was heard today in Court No 2 ( Justice RM Lodha), Item no 9.

Solicitor General appeared for the UOI. He informed the Court that the UOI will file reply before the day's proceedings ends on the Contempt Notice. The Court agreed to the request and also gave 2 weeks time to the Petitioners (RDOA) to file rejoinder if any. The case would be heard thereafter.
Deduction: It would take another three weeks before the case is heard. Also what reply the UOI gives will have to be analysed and reply filed within two weeks by RDOA.

None of the four contemnors (Secretaries) appeared in the Court. Senior Advocate Mr Jagdeep Dhankhar appeared for RDOA.

As per Info available the file pertaining to the infirmities raised by COSC has been sent to the Law Ministry for views of the Attorney General.

Very funny indeed. What did GoI did all these months after contemp notice was given. There should be contemp against SC itself. We must take it to media with all force for this act of SC.

If RDOA think it fit, they could consider sharing details of the reply filed by UOI.

As for the SOC being considered by Ld AG, it may be worthwhile to keep in mind those SOCs may not cover all infirmities as I had pointed out in this comment.

I am amused. It is business as usual for the GOI. Contempt or no contempt does not seem to matter to the babus.
No wonder why disputes are settled more efficiently by extra-judicial functionaries including Khap panchayats in India.
Time, for the Indian judiciary, does not seem to be the essence, in settling disputes.
High time judiciary is made accountable too!

I agree with Bharatiya. Do you think our advocate was weak ? In other case filed by civ in CAT only 3 days are given for making 1.1.2006 as effective date. Even though SC had insisted on presence of comtemnors, none commented ! how this can happen in SC itself ?

there are people who speak to media..It's a suo moto contempt but one who clearly defies SC orders is a law abiding citizen....God is great...

@bharatiya, @ravi mahajan, @Ranjay: You have to wait and see what the reply of the UOI is and what RDOA's rejoinder will be.

The whole process is part of a legal process and we can't respond out of frustration. RDOA have a legal team and surely they know how to repond to an ongoing matter in the Hon'ble Supreme Court.

Unless and until the RDOA insists that the Apex Court takes cognisance of the Contempt, there is every probability that the hearings would continue to be postponed - the one on 17 Feb 14 because UoI/Contemnors had not filed a reply even though 10 weeks had passed.

Do we deserve the treatment we are getting? VK Singh opened his (unwise) mouth and was cited suo moto for contempt. Here the Apex Court ordered "Fail Ye Not", the Contemnors failed, and we await the orders of the Apex Court.

The next date of hearing in Hon'ble SC is 10.3.14.

The Judiciary n Executive work hand in gloves. They don't scratch each other unless necessary. Rank pay case is a classic case of match fixing between these two parties.
